By accessing or using Crosswatch ("the Service") at crosswatch.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms are a legally binding agreement between you and Qaswa Technology ("we," "us," or "our").
Crosswatch is a read-only, vendor-neutral software-as-a-service platform that ingests operational signals from the monitoring tools you connect (RMMs, Microsoft Intune/365, and others), correlates failures across your clients and tools, and warns you when an incident is emerging. It provides advisory AI remediation guidance and can file a ticket in your PSA when you approve it.
Crosswatch is a detection and advisory tool. It is read-only with respect to your devices and never executes changes on them, and it does not constitute a managed security service, incident-response service, or a guarantee that any given failure will be detected. AI-generated remediation guidance is clearly labelled and must be reviewed and approved by a qualified technician before any action is taken.
You must register for a workspace to use the Service. You are responsible for maintaining the confidentiality of your credentials and ingest tokens, and for all activity under your workspace. You must provide accurate information and keep it current, and you may not share credentials except as your plan permits.
The Service is offered on a subscription or pilot basis as described in your plan or order form. Paid subscriptions renew automatically at the end of each billing period unless cancelled; cancellation takes effect at the end of the current period. All fees are in U.S. dollars and are non-refundable except as required by law or as expressly stated. We may change pricing with 30 days' notice; continued use after a change constitutes acceptance. Free pilots and trials are subject to the limits we communicate and may be modified or discontinued at any time.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
You represent that you are authorized to connect the tools and to ingest the telemetry you provide to the Service, including any data relating to your own end clients, and to receive incident notifications about them. You are solely responsible for reviewing AI-generated remediation guidance and for verifying it before acting. Crosswatch is read-only and never executes changes on a device; you approve and run any remediation in your own tools. Use of the Service does not create a managed-services or professional-client relationship between you and Qaswa Technology.
The Service — including its software, design, correlation engine, AI prompts and pipelines, and underlying technology — is owned by Qaswa Technology and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your active subscription. You retain all rights to the data and content you submit; nothing in these Terms transfers ownership of your content to us.
8.1 Your Data Belongs to You. All telemetry, workspace content, and configuration you submit through the Service ("Your Data") remain your property. Qaswa Technology claims no ownership over Your Data.
8.2 Limited License to Process. You grant Qaswa Technology a limited, non-exclusive, royalty-free license to access, store, and process Your Data solely to: (a) provide and operate the Service; (b) perform security monitoring and backup; and (c) respond to support requests. This license ends when you delete the data or close your workspace.
8.3 No Sale of Your Data. We do not sell, rent, license, or otherwise disclose Your Data to third parties for their independent use. We use subprocessors (cloud hosting and the Azure OpenAI Service) solely to operate the Service, subject to confidentiality obligations.
8.4 AI Processing. Incident metadata used to generate remediation guidance is processed by Microsoft's Azure OpenAI Service and, under Microsoft's enterprise terms, is not used to train foundation models. The Crosswatch detection engine is deterministic and does not rely on AI to decide that an incident exists.
8.5 Cross-Fleet Network (Opt-In). The cross-fleet network signal is off by default. If you opt in, only anonymized failure fingerprints and counts are shared — never a client, device, user identity, or tenant identifier.
8.6 Retention & Deletion. We retain Your Data while your workspace is active and delete it from our systems when you offboard or close the workspace. You may request earlier deletion at any time. Aggregated, anonymized statistics that cannot identify you or your clients may be retained.
8.7 Security. We implement industry-standard technical and organizational safeguards, including encryption in transit and at rest, AES-256-GCM encryption of connection secrets, access controls, and a read-only architecture that never writes to your devices. No method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
8.8 Processor Role & Data Processing Agreement. For the telemetry we process on your behalf, Qaswa Technology acts as a processor / service provider and you are the controller. Customers who require a signed Data Processing Agreement (DPA) for compliance purposes — including the Nebraska Data Privacy Act (Neb. Rev. Stat. § 87-1115) and other state privacy laws — may request one by contacting info@qaswatechnology.com. The DPA will govern our data-processing activities on your behalf.
Our collection and use of personal information is governed by our Privacy Policy, incorporated into these Terms by reference. In the event of a conflict between the Privacy Policy and these Terms with respect to data handling, the Privacy Policy governs.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT EVERY INCIDENT WILL BE DETECTED, OR THAT DATA OBTAINED THROUGH THE SERVICE IS ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QASWA TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Qaswa Technology and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your lack of authorization to connect a system or ingest data, or your violation of any third-party rights.
We may suspend or terminate your workspace for violation of these Terms, non-payment, or for any reason with 30 days' notice. Upon termination, your right to use the Service ceases. Sections 6, 7, 8, 10, 11, and 12 survive termination. We will make Your Data available for export for a reasonable period following termination before deletion per Section 8.6.
We may update these Terms from time to time and will notify you of material changes by email or by posting a notice on the Service at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance. If you do not agree to material changes, you may cancel before they take effect.
These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Nebraska.
